TERMS OF USE. The term Alumentor for purposes of the terms herein include Alumentor.com; Alumentor, Inc. and alumentors.com and its agents, employees, and affiliates. The term student refers to the mentee or student to receive mentor service. The term customer refers to the hiring party, whether a parent or student or hiring party. Alumentor claims no contractual connection with any educational program, institution or college. By using the alumentor.com website or Alumentor Inc.’s services and mentoring services, the customer and student expressly acknowledge and agree that no express warranties implied or expressed is conveyed, that no confidentiality right is conveyed, conferred or warranted, that neither the mentor nor Alumentor warrant or guarantee the quality, accuracy or applicability of information conveyed by the mentor. The student and customer agree to independently verify on any information conveyed by Alumentor or any mentor assigned. Student and customer expressly waive and disclaim any claim of any reliance interest. Student and customer further agree to disclaim any assertion or claim that the assigned mentor’s education and experience are inequal to the student’s educational program or experience or applicability thereof. Student and customer agree to limit any claim for damages to the service fee fully remitted to Alumentor. Student and customer agree that any disputes will be decided in Arbitration under the rules of the American Arbitration Association, with such arbitration claim levied within the State of Michigan applying the laws of the State of Michigan. Alumentor does not warrant to provide a graduate of any particular program or specialty or particular quality, but instead only warrants to provide a college graduate as a mentor to provide generalized advice on program completion towards graduation, and nothing more. No warranties regarding any particular representation of any particular mentor or mentor supervisor are made or implied. Mentor and Student and Customer expressly agree not to engage in any additional or extracontractual relationship with each other after mentorship services are engaged with Alumentor. Any further mentoring service by any assigned mentor without involvement of, or payment to Alumentor, is expressly prohibited. Student and customer or any related parties expressly agree to promptly report any inappropriate conduct by any mentor to Alumentor.com within 3 hours of any such claimed event. In such a case, the student and/or customer agree to provide complete and detailed information regarding such claimed inappropriate matter to allow Alumentor to take immediate action. Further, customer and student agree to hold Alumentor harmless for any inappropriate conduct of any mentor not immediately, completely and adequately reported to Alumentor. It is expressly agreed that the student mentorship fee remitted is nonrefundable when remitted to Alumentor notwithstanding any refusal of participation of the student, change of scheduling of mentorship sessions, and the like. Customer agrees not to attempt to charge-back or claim unauthorized merchant charge for any payment remitted for Alumentor mentoring services once remitted, and agrees to pay Alumentor for any fees, charges, penalties, late fees, bank fees, litigation costs and attorney’s fees claimed or incurred by Alumentor defending or collecting any fee remitted or owed to Alumentor by any customer or student.
